These Terms and Conditions ("Terms") govern the use of the NINJABLE B.V. ("NINJABLE") website and the services provided through the SaaS gamification platform available at ninjable.io ("Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Platform.

2. Account Registration

2.1. To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process.

2.2. You are responsible for maintaining the security of your account and password. NINJABLE is not liable for any loss or damage arising from your failure to comply with this security obligation.

3. Use of the Platform

3.1. NINJABLE grants you a non-exclusive, non-transferable, revocable license to access and use the Platform for personal or business purposes.

3.2. You agree not to:

a. Use the Platform for any illegal or unauthorized purpose;
b. Attempt to gain unauthorized access to the Platform;
c. Modify, adapt, or hack the Platform;
d. Interfere with or disrupt the integrity or performance of the Platform.

4. Subscription and Payments

4.1. The use of certain features of the Platform may require a subscription fee. You agree to pay all applicable fees as described on the Platform.

4.2. Subscription fees are non-refundable. NINJABLE reserves the right to change the fees at any time upon notice.

5. Intellectual Property

5.1. The Platform, including all content, features, and functionality, is the exclusive property of NINJABLE and is protected by intellectual property laws.

5.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform.

6. Privacy

6.1. Your use of the Platform is subject to our Privacy Policy, available at https://ninjable.io/privacy-policy.

7. Termination

7.1. NINJABLE reserves the right to terminate or suspend your account and access to the Platform at its sole discretion, without prior notice, for any reason, including a breach of these Terms.

8. Disclaimer of Warranties

8.1. The Platform is provided "as is" and "as available" without any warranties.

9. Limitation of Liability

9.1. NINJABLE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
